Planning Boards and General Municipal Law Sec. 239

Under state law, local Planning Boards are required to notify the County of development proposals that may affect County-owned property or pose “inter-municipal impacts.” Planning’s role is to study the project for potential impacts and to issue an advisory “statement of determination” to the municipality.

In 2010, Planning expedited its process of reviewing and responding on these cases and implemented a policy of meeting with Town officials and involved parties to discuss the projects prior to issuing determinations. Planning staff also organized a meet-and-greet for Planning Boards as well as opportunities for required board training.

Hazard Mitigation

The Division of Planning recently submitted to New York State’s Office of Emergency Management the County’s five-year update to its All-Jurisdiction All-Hazard Mitigation Plan (AHMP). The purpose of the AHMP is to reduce damage from future disasters, thus lowering public expenditures, private losses and “community vulnerability to natural, technological, and man-made hazards.” The plan includes a multi-jurisdictional risk assessment and outlines actions that will minimize costs and impacts from future disasters. The AHMP process, under which municipalities will be asked to adopt the plan in 2011, is essential to obtaining FEMA funding for municipal projects.

Flood Mitigation

In a targeted effort, County Planning is helping to coordinate capital-project planning by the County’s Soil and Water Conservation District, in order to prioritize projects that address areas of repeated damage from flooding. Planning is also the point of contact for studies being undertaken by the Army Corps of Engineers covering watershed systems, beyond individual damage sites.

Every effort is being made to mitigate circumstances that contributed to the devastation caused by prior floods and the impact that flooding has on the local economy, especially with respect to the mixed-use, commercial and residential hamlet districts in the western part of the county.
